TL;DR

We're Odisei Music S.L., with Tax ID: B67566026, a Spanish music-tech company that makes electronic wind instruments and runs the Odisei Instruments and the Odisei Play apps. These Terms of Service ("Terms") describe your rights and responsibilities when you use our website, our online shop, and any related services we provide (together, the "Services"). The store runs on Shopify; the legal relationship for your purchases, however, is between you and Odisei Music S.L. ("Odisei", "we", "us"). By using the Services, you agree to these Terms. If you don't agree, don't use them.

Your Account

To buy from us or use certain features, we may ask for your email, billing and shipping addresses, and payment details. You commit to giving us accurate, current, and complete information, and to keeping your account credentials safe. If someone uses your account, that's on you.

You also confirm that you're at least the age of majority in your country or, if you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

You can't transfer, sell, or hand over your account to anyone else.

Our Products

We do our best to show our instruments accurately on the website: photos, descriptions, specs. That said, colours and finishes may look slightly different on your screen depending on the device you're using and your screen settings.

A few things to know:

  • Descriptions can change: Specs, pricing, availability, and product details may be updated as we improve the lineup.
  • We may discontinue products or limit how many we sell to any one person, region, or country.
  • Mistakes happen: If we spot an error in pricing, availability, or a description — even after you've placed your order — we may correct it, change the order, or cancel it. We'll always notify you and refund you in full if a cancellation affects you.

Orders, Payments & Shipping

  • Placing an order: When you click "buy", you're making an offer to purchase. We then accept or decline at our discretion. The deal isn't sealed until we send you a confirmation, and we must receive payment before we accept. Review your cart carefully — once an order is accepted, we may not be able to change or cancel it.
  • Prices and taxes: The price you pay is the price shown at checkout when you confirm the order; we'll repeat it in your confirmation email. Posted prices may differ from those in physical retailers, third-party platforms, or our other regional stores. Unless we say otherwise, prices exclude VAT, shipping, and any customs or import charges, which are calculated at checkout based on your delivery destination.
  • Promotions: From time to time we run promotions with their own conditions. If a promotion's terms conflict with these general Terms, the promotion's terms take precedence — but only for that promotion.
  • Payment: When you provide a payment method, you confirm it's valid, that you're authorised to use it, and that you'll cover the full charge (product, shipping, taxes, customs).
  • Shipping & delivery: Delivery times are estimates and aren't guaranteed. We're not liable for delays caused by carriers, customs, or events beyond our control. Once we hand your order to the carrier, risk of loss passes to you, but your return and warranty rights still apply per our Shipping & Refund Policy.
  • Personal use only: Your purchases are for your own personal or household use, not for commercial resale or export.

What's Ours, What's Yours

What's ours: Everything you see in our online shop and on our website — our trademarks (Travel Sax 2, Travel Clarinet, Odisei Play), product photos, descriptions, videos, designs, layouts — is owned by Odisei Music S.L. or our licensors and protected by Spanish, EU, and international intellectual property law. You can use the Services for your own personal, non-commercial use; you can't reproduce, modify, republish, redistribute, sell, or otherwise exploit anything from them without our written permission. Shopify's name, logo, and platform marks belong to Shopify.

What's yours: If you submit anything to us — reviews, feedback, ideas, photos, videos, suggestions or "feedback" — you keep ownership, but you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, copy, modify, publish, and display it, including for marketing. In exchange, you confirm:

  • the content is yours to share,
  • you've disclosed any compensation or incentive you received in exchange for it (e.g. a gifted product), and
  • it doesn't infringe anyone else's rights, contain anything unlawful or defamatory, or include malware.

We're not obliged to keep your "feedback" confidential, pay for it, or respond to it. We may also remove or edit any submission that breaks these Terms.

Acceptable Use

The Services are for lawful, personal use. You agree not to use them to:

  • Break any local, national, or international law.
  • Infringe our intellectual property or anyone else's.
  • Harass, defame, intimidate, or harm anyone, including our team and other customers.
  • Send spam, phishing, or chain mail through our Services.
  • Impersonate someone else, misrepresent your identity, or post false information.
  • Upload viruses, malware, or anything that could break our Services.
  • Scrape, crawl, or harvest data from our Services.
  • Resell or commercially exploit any part of the Services.
  • Bypass our security features or interfere with other users' access.

If you break any of these rules, we may suspend or terminate your account without notice. You'll still be liable for anything you owe us up to that point.

Warranties, Liability and Consumer Rights

Your local consumer rights come first. We ship worldwide, and the law that protects you depends on where you live. Nothing in these Terms reduces or removes the mandatory consumer rights you have under your country's law — whether that's the EU's 14-day right of withdrawal and 1-year statutory warranty (3 year warranty in the EU), the United States' implied warranties of merchantability and fitness, Australia's Consumer Law guarantees, or any equivalent protection elsewhere. Those rights stand. Wherever a clause below would conflict with them, your statutory rights prevail. Country-specific details on how to exercise them are in our Shipping & Refund Policy.

What We Cover and What Not

If a product is defective or an order goes sideways, we'll refund or replace it under your statutory rights and our Shipping & Refund Policy. What we won't cover — where the law lets us limit it — are the knock-on consequences: what lawyers call indirect, incidental, special, punitive, or consequential losses. And where the law lets us cap what we owe, the most we'll ever pay you for a single claim is the amount you paid for the product that triggered it.

Wherever you live entitles you to stronger protection, that protection applies on top of all this.

Termination

You can leave us at any time — by stopping using the Services, or email us to close your account. Easy peasy.

We can also close your account at our end, without notice, if you've broken these Terms or used the Services in a way that could harm us or other users.

Governing Law & Disputes

These Terms are governed by Spanish law, and any dispute that ends up in court will be heard in Barcelona, Spain — that's where we're based. Wherever you live, the mandatory consumer protections in your country still apply. If your local law gives you the right to bring a claim in your home country's courts, this clause doesn't take that away.

Future Changes

We may update this policy when our practices evolve or the law requires it. When we do, we'll post the new version here and refresh the "Last updated" date at the top. For material changes — a new processing purpose, a new category of recipient, anything that meaningfully shifts how your data is handled — we'll give you advance notice by email or via a banner on the site, at least 30 days before the change takes effect.
